The intent of these regulations is to expand the availability of locally-grown food and promote options for urban farming. The
existing Land Development Code does not currently have a provision to permit community gardens. These new regulations are
intended to be added to the existing Arapahoe County Land Development Code for unincorporated areas, specifically Community
Gardens – Section 12-2200 and Farmers’ Markets – Section 12-2300. These regulations provide options for neighborhood residents,
community groups and volunteer organizations to locate community gardens in areas that are under common or public ownership
to offer some assurance that these gardens can be maintained over time. Outdoor Farmers’ Markets may be allowed as a temporary
use, subject to the requirements outlined in these proposed regulations and with prior approval of a Temporary Use Permit
under the provisions in Section 12-600 of the Land Development Code.
On March 13, 2012, these new code sections went to the Planning Commission under one case number – W12-002. For ease of discussion,
the two sections have been split into two separate case numbers. The text in red denotes changes resulting from the Planning
Commission hearing on March 13, 2012.
